AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

When a peace officer retires, the chief of the department must submit a form to the Texas Commission on Law Enforcement Officer Standards and Education indicating the officer's standing from among three options: general discharge, honorably discharged, or dishonorably discharged.  Current law allows an honorably retired officer to request an identification card from the agency from which he has retired.  The chief of the officer's former department has the option of whether or not to issue that identification card.  H.B. 2068 would remove the discretion of the chief and specify that the chief shall, upon request, issue an identification card indicating an officer's status as an honorably retired officer.

 

H.B. 2068 relates to an identification card for certain retired peace officers.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 1701.357(i), Occupations Code, to require, rather than authorize, that the head of the, rather than a, state or local law enforcement agency from which the officer retired issue to the retired officer identification that indicates that the officer honorably retired from the agency on request of an honorably retired officer, rather than a retired officer, who holds a certificate of proficiency under this section. 

 

SECTION 2.  Effective date: upon passage or September 1, 2009.
