BILL ANALYSIS

H.B. 2107

By: Orr

Transportation

Committee Report (Unamended)

BACKGROUND AND PURPOSE

Texas law allows recreational vehicle (RV) shows to be held on Saturdays and Sundays, but on only one of those days can RVs actually be sold.  On the non-sale day, prices cannot even be quoted or posted at the shows.  This creates a bizarre scenario in which a show is licensed and legal on a certain day but prices cannot be mentioned, either verbally or in writing.

H.B. 2107 amends the law so that licensed RV shows can quote prices on both days of a show that runs on consecutive days of Saturday and Sunday.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2107 amends the Transportation Code to establish that provisions prohibiting the sale of motor vehicles on consecutive days of Saturday and Sunday do not prohibit the quoting of a price for a motor home or towable recreational vehicle at a show or exhibition described by provisions relating to dealer participation in a new motor vehicle show.

EFFECTIVE DATE

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
