BACKGROUND AND PURPOSE

 

H.B. 2208 requires the Rio Grande Regional Water Authority to exclude certain sales from the calculation of the current market value of water rights.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 2208 amends the Water Code to require the Rio Grande Regional Water Authority to exclude from the calculation of current market value under existing statute any sale between a municipal water supplier and a district if any territory inside the outer boundaries of the district is subject to the municipal water supplier's certificate of convenience and necessity or is in the corporate limits of the municipality served by the municipal water supplier, if the supplier does not hold a certificate of convenience and necessity. The bill defines "outer boundaries of a district" for the purposes of this provision to mean a district's boundaries without considering any exclusion of land from inside the district.
