BACKGROUND AND PURPOSE

Current law places certain restrictions on holders of Class A, B, or C driver's licenses when the person is under 18 years of age.  While the restriction does not apply to the holder of a hardship license, they do apply following the issuance of an original Class A, B, or C license. The restrictions come as a surprise to those who have been driving without such restrictions.

 

H.B. 2323 removes the restrictions for those who have held a hardship license.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 2323 amends the Transportation Code to establish that the prohibitions against persons under 18 years of age who are operating vehicles do not apply to a person who held a hardship license immediately preceding the issuance of an original Class A, B, or C driver's license. 

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
