AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under Section 707.017 (Photographic Traffic Signal Enforcement System), Transportation Code, a county tax-assessor collector can refuse to register a vehicle which has unpaid red light camera violations.  This section currently allows a "hidden lien" to be placed on a vehicle, which blocks an innocent party from registering a newly purchased vehicle.  Blocking registration creates a liability for motor vehicle dealers who are required by statute to register and pay sales tax, within 20 working days, on the vehicles they sell to customers.

 

H.B. 2530 exempts dealer transfers from being blocked because of the indebtedness of a prior owner, thus allowing the transfer to take place and sales tax to be collected.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 707.017, Transportation Code, as follows:

 

Sec. 707.017.  ENFORCEMENT.  (a)  Creates this subsection from existing text.

 

(b)  Provides that this section does not apply to the registration of a motor vehicle under Section 501.0234 (Duty of Vehicle Dealer on Sale of Certain Vehicles).

 

SECTION 2.  Effective date:  upon passage or September 1, 2009.
