BACKGROUND AND PURPOSE

 

In December 2003, the Texas Transportation Commission passed a minute order mandating that the executive director of the Texas Department of Transportation establish and implement guidelines for evaluating mobility projects on the state highway system for development as toll projects.

 

H.B. 2557 prohibits the commission from requiring that every mobility project be evaluated for tolling.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 2557 amends the Transportation Code to prohibit the Texas Transportation Commission from requiring that each highway or other mobility project that is proposed, in development, or under construction be evaluated for tolling.  

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
