H.B. 2847 amends current law relating to using county election precincts for any election held on the November uniform election date.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Sections 42.002(a), Election Code, as follows:
(a) Provides that the county election precincts are the election precincts for certain elections, including, as provided by Section 42.0621 (Precincts for November Election), any other election held on the November uniform election date of a political subdivision, other than a district that is created under Section 52 (Counties, Cities or Other Political Corporations or Subdivisions; Lending Credit; Grants; Bonds), Article III (Legislative Department), or Section 59 (Conservation and Development of Natural Resources and Parks and Recreational Facilities; Conservation and Reclamation Districts), Article XVI (General Provisions), Texas Constitution, and is located in a county with a population of more than 3.3 million or a county adjacent to a county with a population of more than 3.3 million, rather than as provided by Section 42.0621, any other election held on the November uniform election date of a school district located in any county and a political subdivision, other than a school district, not located in a county with a population of more than 3.3 million or a county adjacent to a county with a population of more than 3.3 million.
SECTION 2. Amends Section 42.0621(a), Election Code, to require the political subdivisions to which Section 42.002(a)(5) applies to use the regular county election precincts, rather than requiring the political subdivisions described by Section 42.002(a)(5) to use the regular county election precincts.
SECTION 3. Effective date: September 1, 2009.
