AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Cibolo Creek Municipal Authority (CCMA) has provided wholesale sewer service in the area between San Antonio and New Braunfels in parts of Guadalupe, Bexar, and Comal counties since 1971.  For many years, CCMA has provided sewer service both within its boundaries and in areas outside of its boundaries through long-term contracts with several cities.  The new areas that are presently outside CCMA’s boundaries include territory within the jurisdiction or service areas of the cities of Live Oak, Schertz, and Cibolo, which have passed resolutions in support of inclusion of this new territory within CCMA's boundaries.  The boundary expansion will provide those residents with the opportunity to vote in CCMA elections and to have representation on the board of directors of CCMA.

 

H.B. 2906 relates to the expansion of the boundaries of CCMA.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 4, Chapter 347, Acts of the 62nd Legislature, Regular Session, 1971, to set forth the required territory of the Cibolo Creek Municipal Authority. 

 

SECTION 2.  Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 3.  Effective date: upon passage or September 1, 2009.
