BACKGROUND AND PURPOSE

 

The Cibolo Creek Municipal Authority (CCMA) has provided wholesale sewer service in the area between San Antonio and New Braunfels in parts of Guadalupe, Bexar, and Comal Counties since 1971. For many years, CCMA has provided sewer service both within its boundaries and in areas outside of its boundaries through long-term contracts with several cities. The new areas that are presently outside CCMA’s boundaries include territory within the jurisdiction or service areas of the cities of Live Oak, Schertz, and Cibolo, which have passed resolutions in support of inclusion of this new territory within the CCMA’s boundaries. The boundary expansion will provide those residents with the opportunity to vote in CCMA elections and to have representation on the CCMA board of directors.

 

C.S.H.B. 2906 expands the boundaries of the Cibolo Creek Municipal Authority to include areas outside of its boundaries presently served by contract.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

C.S.H.B. 2906 amends Section 4, Chapter 347, Acts of the 62nd Legislature, Regular Session, 1971, to expand the boundaries of the Cibolo Creek Municipal Authority. The bill sets forth the composition of the district territory.

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
