BACKGROUND AND PURPOSE

 

Current law authorizes a majority of persons who would serve as members of a county bail bond board in a county with a population of less than 110,000 to create a county bail bond board without any action by the commissioners court of the county.

 

C.S.H.B. 3003 authorizes a commissioners court and a majority of persons who would serve as members of a county bail bond board to approve the creation of a board in a county with a population of less than 110,000.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

C.S.H.B. 3003 amends the Occupations Code to authorize a commissioners court of a county with a population of less than 110,000 to create a bail bond board if it approves the creation of the board by a majority vote in addition to the existing requirement that a majority of persons who would serve as members or designate the persons who would serve as members of the board determine to create a board.

 

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.

COMPARISON OF ORIGINAL AND SUBSTITUTE

C.S.H.B. 3003 removes provisions from the original authorizing a commissioners court of a county to dissolve a county bail bond board created under the substitute's provisions if the commissioners court approves the dissolution by a majority vote and adopts written procedures to wind up the board's operations.
