AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Housing authorities throughout Texas work to enhance the lives of millions of people by providing quality affordable housing to the most vulnerable members of society.  Presently, there is a great need for housing for veterans who served on active duty in the armed forces of the United States or in the state military forces. This bill, which supports the efforts of housing authorities to develop housing for veterans throughout Texas without limitations of geographical boundaries, impacts housing authorities in counties with a population of more than one million and empowers those authorities to develop housing communities for veterans.

 

This bill authorizes a county or municipal housing authority in a county with a population of more than one million to borrow money, accept grants, and exercise its powers to provide safe and sanitary housing for veterans.

 

C.S.H.B. 3358 amends current law relating to allowing municipal or county housing authorities in certain counties to create housing communities for veterans.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter D, Chapter 392, Local Government Code, by adding Section 392.067, as follows:

 

Sec. 392.067.  VETERANS HOUSING IN CERTAIN COUNTIES.  (a)  Defines "veteran."

 

(b)  Authorizes a county or municipal housing authority (authority) in a county with a population of more than 500,000 to borrow money, accept grants, and exercise its powers to provide safe and sanitary housing communities for veterans.

 

(c)  Authorizes an authority, as the authority considers necessary to achieve the purposes of this chapter, to enter into a lease or purchase agreement or accept a conveyance regarding real property as part of a housing project that will benefit veterans.  Authorizes the agreement or conveyance to include any restrictive covenants that the authority considers appropriate regarding the property.  Provides that as the authority considers necessary and on the stipulation of the parties, the covenants run with the property.

 

(d)  Provides that a county or municipal housing authority to which this section applies is not subject to the limitations in Section 392.014 (Area of Operation of a Municipal Housing Authority), 392.015 (Area of Operation of a County Housing Authority), or 392.017 (Operation of Housing Authority in Other Political Subdivisions) with respect to a housing project that benefits veterans as authorized by this section.

 

SECTION 2.  Effective date: September 1, 2009.
