AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The City of Dallas, more than 10 years ago, embarked upon the massive $2 billion Trinity River Corridor Project.  In addition to a planned roadway to relieve nearby downtown and arterial congestion, the project also contains environmental, economic development, and recreational components.  The desired property, as part of this public work project, has the planned use for the Downtown (Reunion) Overlook deck area structure.

 

This bill authorizes the transfer of certain real property from the Texas Department of Criminal Justice (TDCJ) to the City of Dallas to be used as part of the Trinity River Corridor Project. The real property is currently used for the Dawson State Jail facility and is owned by TDCJ.  The bill calls for the City of Dallas to locate and provide compatible and suitable real property within reasonable proximity of the current facility, in exchange for the land now occupied by the Dawson State Jail.

 

H.B. 3438 amends current law relating to authorizing the Texas Board of Criminal Justice to convey certain real property to the City of Dallas in exchange for comparable property.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  (a)  Authorizes the Texas Board of Criminal Justice (TBCJ) to convey the real property described by Section 2 of this Act to the City of Dallas if the City of Dallas conveys real property to TBCJ that is not more than 20 miles from the property line of the real property described by Section 2 of this Act and on which there is a facility TBCJ determines is comparable to the Dawson State Jail Facility located on the property described by Section 2 of this Act.

 

(b)  Requires the General Land Office to negotiate and close a transaction under this section on behalf of TBCJ.

 

(c)  Provides that Section 272.001 (Notice of Sale or Exchange of Land by Political Subdivision; Exceptions), Local Government Code, and Section 31.158 (Real Estate Transactions Authorized by Legislature), Natural Resources Code, do not apply to a transaction under this section.

 

SECTION 2.  Sets forth the boundaries of the real property to which this Act applies.

 

SECTION 3.  Effective date: upon passage or September 1, 2009.
