AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently the county clerk of each Texas county must mail two copies of a financial statement form to each county officer, candidate for a county office, justice of the peace, or candidate for the office of justice of the peace as provided by Section 159.003 (Financial Statement Required), Local Government Code.  As county government has increasingly moved to paperless-type programs and the use of electronic mail there is a need to allow an efficient use of technology to comply with the duties of county clerks across the state.

 

H.B. 3602 allows a county clerk to use electronic mail to provide the financial statement form to the county officer, justice of the peace, or candidate for such offices in place of mailing a physical document.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 159.005(b), Local Government Code, to require the county clerk to mail or, at the request of the person required to file under this subchapter to send by electronic mail, two copies of the form to each person required to file under this subchapter within the time prescribed by Section 572.030(c) (relating to required notice under certain sections to be mailed), Government Code.

 

SECTION 2.  Effective date: upon passage or September 1, 2009.
