AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Texas State Trooper Scott Burns from Linden, in Cass County, was killed in the line of duty on April 29, 2008, in Jefferson, Texas.  Trooper Burns' area of patrol included highways in Marion and Cass Counties. 

 

This legislation designates a 15-mile segment of U.S. Highway 59 between Linden, Texas, and Jefferson, Texas, as the Trooper Scott Burns Memorial Highway.  The bill requires the Texas Department of Transportation (TxDOT) to design and construct markers indicating the highway number, the designation as the Trooper Scott Burns Memorial Highway, and any other appropriate information and requires TxDOT to erect a marker at each end of the highway and at appropriate intermediate sites along the highway. 

 

H.B. 3800 relates to the designation of a portion of U.S. Highway 59 as the Trooper Scott Burns Memorial Highway. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 225, Transportation Code, by adding Section 225.081, as follows:

 

Sec.  225.081.  TROOPER SCOOT BURNS MEMORIAL HIGHWAY.  (a)  Provides that U.S. Highway 59 between the northern corporate limits of the City of Jefferson and the southern corporate limits of the City of Linden is designated as the Trooper Scott Burns Memorial Highway. 

 

(b)  Requires the Texas Department of Transportation (TxDOT), subject to Section 225.021(c) (relating to TxDOT not being required to design, construct, or erect a marker under this subchapter unless a certain grant or donation of funds is made), to design and construct markers indicating the highway number, the designation as the Trooper Scott Burns Memorial Highway, and any other appropriate information, and erect a marker at each end of the highway and at appropriate intermediate sites along the highway. 

 

SECTION 2.  Effective date:  September 1, 2009.
