BACKGROUND AND PURPOSE

Currently, the Texas Alcoholic Beverage Code specifies that members of the Texas Alcoholic Beverage Commission receive a per diem of $10 a day, while provisions of the General Appropriations Act provide that commissioners receive $30 a day.  The amount specified in the General Appropriations Act is reviewed each legislative session and increased as needed, whereas the Alcoholic Beverage Code is not routinely updated to reflect the General Appropriations Act.

H.B. 3829 removes the conflict between the Alcoholic Beverage Code and the General Appropriations Act by providing that members of the Texas Alcoholic Beverage Commission receive a per diem in accordance with the General Appropriations Act.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 3829 amends the Alcoholic Beverage Code to provide that members of the Texas Alcoholic Beverage Commission receive per diem as provided by the General Appropriations Act, rather than per diem of $10 a day, while attending commission meetings or otherwise engaged in the performance of their duties. 

EFFECTIVE DATE

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
