AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, if an individual or entity wishes to donate a building to the Texas Parks and Wildlife Department (TPWD), they must go through a competitive bidding and approval process that increases the costs of the project and may deter the individual or entity from making the donation.
This bill authorizes TPWD to accept the donation of a turnkey building project on state land if TPWD approves the plans and engineering in advance and has supervision over the project. The bill provides that such a project is not subject to the competitive bidding process and grants the Texas Parks and Wildlife Commission rulemaking authority.
H.B. 3864 amends current law relating to the acceptance of certain donated building projects by the Texas Parks and Wildlife Department.
RULEMAKING AUTHORITY
Rulemaking authority is expressly granted to the Texas Parks and Wildlife Commission in SECTION 1 (Section 11.0285, Parks and Wildlife Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter B, Chapter 11, Parks and Wildlife Code, by adding Section 11.0285, as follows:
Sec. 11.0285. DONATED BUILDING PROJECTS. (a) Authorizes the Texas Parks and Wildlife Department (TPWD) to accept the donation of a turnkey building project on state land provided that TPWD approves the plans and engineering in advance and has supervision over the project.
(b) Provides that a project under this section is not subject to competitive bidding.
(c) Authorizes the Texas Parks and Wildlife Commission to adopt rules to implement this section.
SECTION 2. Effective date: upon passage or September 1, 2009.
