BACKGROUND AND PURPOSE

 

A juvenile case manager can be used in municipal and justice courts for the purpose of aiding juvenile justice cases.  A juvenile case manager fund may be established by a city or county for paying the salary and benefits of a case manager.  However, other expenses accrue in the performance of the job; operational and maintenance costs such as licensing, training, travel, and office supplies are essential to the case manager program.  In Houston, these necessary expenses, as well as salary and benefits for court counselors, are paid for out of the city's general fund. 

 

C.S.H.B. 3880 authorizes a court that employs a juvenile case manager to pay, in addition to the salary and benefits, the training expenses, travel expenses, costs of office supplies, and other operating and maintenance costs of the juvenile case manager, from the juvenile case manager fund.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

C.S.H.B. 3880 amends the Code of Criminal Procedure to authorize a court that employs a juvenile case manager to pay, in addition to the salary and benefits of the juvenile case manager, the training expenses, travel expenses, costs of office supplies, and other operating and maintenance costs of the juvenile case manager, from the juvenile case manager fund.  The bill makes conforming changes relating to the authorized uses of money in the juvenile case manager fund.

September 1, 2009.

COMPARISON OF ORIGINAL AND SUBSTITUTE

C.S.H.B. 3880 differs from the original by removing the licensing expenses of a juvenile case manager from the expenses that a court employing the juvenile case manager is authorized to pay from the juvenile case manager fund and by making a conforming change relating to the authorized uses of money in the juvenile case manager fund.
