AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, there are no statues, memorials, or commemorations on the Capitol grounds that pay tribute to the contributions of Tejanos to Texas.  The Juneteenth Memorial monument, located on the historic Capitol grounds, is a similar type of monument that memorializes the emancipation of slaves in Texas.

 

According to the Texas Administrative Code, no additional memorials and/or monuments shall be placed on historic Capitol grounds except as authorized by Section 448.034 (Location of Monument), Government Code.

 

C.S.H.B. 4114 amends current law relating to memorial monuments on the Capitol grounds, including the Tejano monument.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 443, Government Code, by adding Section 443.01525, as follows:

 

Sec.  443.01525.  TEJANO MEMORIAL MONUMENT. Requires the State Preservation Board to establish a Tejano memorial monument on the historic south grounds of the Capitol that pays tribute to the contributions of the Tejanos to the State of Texas.

 

SECTION 2.  Amends Section 443.0152, Government Code, by adding Subsection (a-1), to prohibit any additional monuments, except as provided by Sections 443.01525 and 448.034 (Location of Monument), after September 1, 2009, from being placed on the historic grounds of the Capitol.

 

SECTION 3.  Effective date: upon passage or September 1, 2009.
