BACKGROUND AND PURPOSE

 

Current law, in response to the negative impact that a slum or blighted area has on the social, health, and economic welfare of the communities in which they exist, authorizes a municipality to repair and rehabilitate slum and blighted areas. Current law also authorizes a county to exercise this power with respect to an area of the county that is not within the corporate boundaries of a municipality if the county has a population of 1.3 million or more.  

 

The bill seeks to ensure that certain counties and municipalities can maximize their combined resources to stimulate growth within affected communities through the use of urban renewal powers as set out by the statute.

 

C.S.H.B. 4542 allows certain counties to exercise urban renewal powers in specified areas of the county.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

C.S.H.B. 4542 amends the Local Government Code to authorize a county with a population of more than 60,000 and less than 300,000 and located along an international border or a county with a population of more than 1.3 million to exercise urban renewal powers with respect to areas of the county located within the corporate boundaries of a municipality that approves the county's participation in an urban renewal project through an interlocal agreement under the Interlocal Cooperation Act, in addition to areas of the county that are not within the corporate boundaries of a municipality.

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.

 

COMPARISON OF ORIGINAL AND SUBSTITUTE

C.S.H.B. 4542 differs from the original by authorizing a county with a population of more than 60,000 and less than 300,000 and located along an international border or a county with a population of more than 1.3 million to exercise urban renewal powers with respect to areas of the county located within the corporate boundaries of a municipality that approves the county's participation in an urban renewal project through an interlocal agreement under the Interlocal Cooperation Act, in addition to areas of the county that are not within the corporate boundaries of a municipality, whereas the original decreases from 1.3 million to 193,000 the minimum population of a county that is authorized to exercise urban renewal powers with respect to areas of the county that are not within the corporate boundaries of a municipality.
