BACKGROUND AND PURPOSE

 

Recently, some city police officers have been patrolling state highways in neighboring counties and ticketing overweight tractor trailers in the neighboring county. The individual responsible for the ticket is required to pay the ticket in the county in which the officer issuing the ticket serves. Because these counties share a small portion of the city, city police that issue tickets in the county not containing the majority of the city cause that county to lose revenue.

 

C.S.H.B. 4594 clarifies the portion of roads on which an oversize or overweight vehicle with a permit issued by Chambers County is authorized to transport cargo in an effort to remedy this situation.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

C.S.H.B. 4594 amends the Transportation Code to clarify that a permit issued by Chambers County for an oversize or overweight vehicle authorizes such a vehicle to transport cargo on Farm-to-Market Road 1405 between its intersection with F.M. 2354 and its intersection with F.M. 565 and to authorize such a vehicle holding a permit to additionally transport cargo on F.M. 565 from its intersection with F.M. 1405 east approximately 6,200 linear feet to the western edge of a certain 10-foot pipeline easement recorded in the county's deed records, and on F.M. 2354 from its intersection with F.M. 1405 northwest approximately 300 linear feet to the termination of the state-maintained portion of the road. 

 

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.

COMPARISON OF ORIGINAL AND SUBSTITUTE

C.S.H.B. 4594 differs from the original by clarifying the portions of Farm-to-Market Road 1405 and F.M. 2354 for which a permit for the movement of oversize and overweight vehicles in Chambers County may authorize the transport of cargo.
