BACKGROUND AND PURPOSE

Current law governing statutory county courts addresses county courts at law in general and specific courts at law in different Texas counties.  Unlike statutes governing some other counties, the statute that governs the salary of a court at law judge in Hidalgo County has no maximum amount of salary for a court at law judge in Hidalgo County.

H.B. 4760 clarifies language to establish a minimum annual salary a Hidalgo County court at law judge may be paid. The bill clarifies that a judge of the county court at law may be paid more than the minimum annual salary required in the provision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 4760 amends the Government Code to establish a minimum annual salary for a judge of a county court at law in Hidalgo County and to authorize such a judge to be paid more than the minimum annual salary that the judge is required to be paid under state law.

EFFECTIVE DATE

September 1, 2009.
