BACKGROUND AND PURPOSE

 

H.B. 4795 relates to the boundaries and name of the Harris County Improvement District No. 10B. To the extent not otherwise in conflict with Chapter 3860, Special District Local Laws Code, the district operates under Chapter 375, Local Government Code, applicable to municipal management districts. 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 4795 validates and confirms all governmental acts and proceedings of the Harris County Improvement District No. 10 and the Harris County Improvement District No. 10B that were taken before the effective date of this bill in relation to the creation of the Harris County Improvement District No. 10B from land inside the Harris County Improvement District No. 10.  The bill specifies that the acts and proceedings may not be held invalid because they were not in accordance with the law governing the Harris County Improvement District No. 10 or other law. The bill provides that its provisions do not apply to any matter that on the effective date of this bill is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment, or has been held invalid by a final court judgment.

 

H.B. 4795 changes the name of the Harris County Improvement District No. 10B to Five Corners Improvement District, and specifies that a reference in law to the Harris County Improvement District No. 10B means the Five Corners Improvement District. The bill describes land to be included in the Five Corners Improvement District and sets forth findings relating to introduction of the bill.

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.

EXPLANATION OF AMENDMENTS

Committee Amendment No. 1.

 

H.B. 4795 is amended to specify that the land described in the bill to be included in the Five Corners Improvement District is save and except any land within the boundaries of Harris County Municipal Utility District No. 390, Harris County Municipal Utility District No. 393, and Harris County Municipal Utility District No. 404 as of the effective date of this bill.
