BACKGROUND AND PURPOSE
Current law provides that if the Lavaca County Groundwater Conservation District was not confirmed, the elected directors shall take office as temporary directors and may hold a subsequent confirmation election on the uniform election date in May 2010 or 2012.
H.B. 4812 authorizes the district to hold the confirmation election on any uniform election date in 2010 or 2012.

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 4812 amends the Special District Local Laws Code to authorize elected directors of the Lavaca County Groundwater Conservation District to hold a subsequent confirmation election on any uniform election date in 2010 or 2012, rather than on the uniform election date in May 2010 or 2012, if the majority of the votes cast at an election on the uniform election date in May 2008 to confirm the creation of the district are not in favor of creation of the district.

EFFECTIVE DATE
On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
