BACKGROUND AND PURPOSE

 

The Crockett County Water Control and Improvement District was created on December 2, 1940.

 

H.B. 4831 allows the district to hold elections for directors of the board at any location in the boundaries of the district and Crockett County on the uniform election date in November of each even-numbered year. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

 

H.B. 4831 amends the Special District Local Laws Code to require the Crockett County Water Control and Improvement District to hold an election to elect the appropriate number of directors to the board of directors on the uniform election date in November of each even-numbered year.  The bill authorizes the election to be held at any location that is in the boundaries of the district and Crockett County.  The bill requires a director of the board of the district serving on the day before the effective date of these provisions to serve until the director's term expires, a director whose term expires in May 2010 to serve until the director's successor has qualified following the directors' election held on the uniform election date in November 2010, and a director whose term expires in May 2012 to serve until the director's successor has qualified following the directors' election held on the uniform election date in November 2012.  The bill defines "board," "director," and "district."

 

H.B. 4831 validates, ratifies, and confirms in all respects all governmental acts and proceedings of the district relating to the election of members of the board of directors of the district that were taken before the effective date of the bill as if they had been taken as authorized by law, except any matter that on the effective date of the bill is involved in litigation if the litigation ultimately results in the matter being held invalid by a final court judgment or has been held invalid by a final court judgment.

 

EFFECTIVE DATE

 

On passage, or, if the act does not receive the necessary vote, the act takes effect September 1, 2009.
