BACKGROUND AND PURPOSE

 

The Texas Constitution uses multiple terms to refer to what is now known as the "Permanent School Fund."  The presence of older, no longer utilized terms such as "Permanent Free Public School Fund" and "perpetual public school fund" can cause confusion.

 

H.J.R. 114 provides a uniform use of the term "permanent school fund" in the Constitution.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this resolution does not expressly grant any additional  rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

H.J.R. 114 amends certain provisions in the Texas Constitution to uniformly refer to the Permanent School Fund instead of the various other names for what is legally considered the Permanent School Fund.

 

H.J.R. 114 sets forth the required language for the ballot.

 

ELECTION DATE

 

The constitutional amendment proposed by this joint resolution will be submitted to the voters at

an election to be held November 3, 2009.
