AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The purpose of this legislation is to ensure that parents are properly informed regarding their child's proposed disciplinary placement. 

 

As proposed,  S.B. 33 requires a school district to provide the parent(s) of a child who has been assigned to a disciplinary alternative education program (DAEP) with information about the student's right to access programs that assist students in completing the coursework required for graduation. S.B. 33 also requires the school principal or other appropriate administrator to prepare and maintain documentation regarding the conference required to be held with the student, parent(s), and appropriate school officials.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 37.008, Education Code, by adding Subsection (l-1), to require a school district to provide the parents of a student removed to a disciplinary alternative education program with written notice of the district's obligation under Subsection (l) (relating to the completion of coursework for graduation in a disciplinary alternative education program) to provide the student with an opportunity to complete coursework required for graduation.  Sets forth information required to be included in the notice.

 

SECTION 2.  Amends Section 37.009, Education Code, by adding Subsection (a-1), to require a school principal or other appropriate administrator to prepare and maintain documentation regarding each conference held under Subsection (a) (relating to a conference).  Sets forth certain information relating to the conference that is required in such documentation.  

 

SECTION 3.  Makes application of this Act prospective to the 2009-2010 school year.

 

SECTION 4.  Effective date: upon passage or September 1, 2009.
