AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Persons with diabetes who receive insulin injections multiple times daily often struggle with having to repeatedly give themselves injections. There are new devices that facilitate insulin therapy; however, these typically are not covered by private health insurance.
As proposed, S.B. 64 adds language to the current statute so that "diabetes equipment" and "diabetes supplies" include devices that facilitate insulin therapy and enhance glucose control.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Sections 1358.051(1) and (2), Insurance Code, as follows:
(1) Redefines "diabetes equipment" to include devices that facilitate insulin therapy and enhance glucose control.
(2) Redefines "diabetes supplies" to include devices that facilitate insulin therapy and enhance glucose control.
SECTION 2. Makes application of this Act prospective to an insurance policy that is delivered, issued for delivery, or renewed on or after January 1, 2010.
SECTION 3. Effective date: September 1, 2009.
