AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, there is no law or regulation prohibiting sex offenders from being licensed as emergency medical technicians (EMTs).  The Department of State Health Services makes a determination about who can be licensed on an individual basis.  This has allowed some sex offenders to be licensed.

 

As proposed,  S.B. 492 prohibits a person who has been convicted of or placed on deferred adjudication for an offense for which the person must register as a sex offender from being certified as any type of emergency medical services personnel.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter C, Chapter 773, Health and Safety Code, by adding Section 773.0415, as follows:

 

Sec. 773.0415.  CERTIFICATION OF SEX OFFENDER PROHIBITED.  Prohibits a person who has been convicted of or placed on deferred adjudication for an offense for which the person is subject to registration under Chapter 62 (Sex Offender Registration Program), Code of Criminal Procedure, from being certified as any type of emergency medical services personnel under this chapter. 

 

SECTION 2.  (a)  Makes application of this Act prospective.

 

(b)  Provides that the change in law made by this Act applies to an application for an emergency medical technician certificate that is pending on the effective date of this Act or that is filed on or after the date.

 

SECTION 3.  Effective date:  September 1, 2009.
