AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

Currently, Blanco, Burnet, Llano, and San Saba Counties are served by the two judges from the 33rd Judicial District and the 424th Judicial District.  While these two judges share the workload of the region, current law provides that the judge with the most seniority serves as administrative judge.

As proposed, S.B. 657 provides that the local administrative judge for Blanco, Burnet, Llano, and San Saba Counties is selected on the basis of rotation from the district judges of the 33rd Judicial District and the 424th Judicial District.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 74.097, Government Code, to provides that, notwithstanding Section 74.091(b) (relating to the election of a district judge as local administrative judge), the local administrative district judge for Blanco, Burnet, Llano, and San Saba Counties is selected on the basis of rotation, rather than seniority, from the district judges of the 33rd Judicial District and the 424th Judicial District.

SECTION 2.  Effective date: upon passage or September 1, 2009.
