AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

All assaultive offenses other than intoxication assault currently qualify law enforcement officers for injury leave.

 

As proposed,  S.B. 687 adds intoxication assault to the list of assaultive offenses for which a law enforcement officer is entitled to injury leave.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 661.918(b), Government Code, to entitle a peace officer to whom this section applies to injury leave, without a deduction in salary, without being required to use compensatory time off accrued under Chapter 659 (Compensation), and without being required to use any other type of leave allowable under this chapter, for an injury resulting from an intoxication assault under Section 49.07 (Intoxication Assault), Penal Code, to which the person is exposed because of the nature of the person's duties and that occurs during the course of the person's performance of duty. 

 

SECTION 2.  Makes application of this Act prospective to January 1, 2009.

 

SECTION 3.  Effective date: September 1, 2009.
