AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The sale of ale and malt liquor by wholesalers, general class B wholesalers, and local class B wholesalers to the holder of a private club registration permit is prohibited under current statute.

 

S.B. 731 authorizes a holder of a wholesaler's, general class B wholesaler's, or local class B wholesaler's permit to sell ale and malt liquor to the holder of a private club registration permit.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 19.01, Alcoholic Beverage Code, to authorize the holder of a wholesaler's permit to sell ale and malt liquor to a holder of a private club registration permit.

 

SECTION 2.  Amends Section 20.01, Alcoholic Beverage Code, to authorize the holder of a general class B wholesaler's permit to sell ale and malt liquor to a holder of a private club registration permit.

 

SECTION 3.  Amends Section 21.01, Alcoholic Beverage Code, to authorize the holder of a local class B wholesaler's permit to sell ale and malt liquor to a holder of a private club registration permit. 

 

SECTION 4.  Effective date: September 1, 2009.
