AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

It is currently a Class B misdemeanor for a person who has cause to believe a child's physical or mental health or welfare has been or may be adversely affected by abuse or neglect to knowingly fail to make a report.

 

As proposed,  S.B. 788 amends Section 261.101 (Persons Required to Report; Time to Report), to match Section 261.109 (Failure to Report; Penalty) to require a person having cause to believe a child's physical or mental health or welfare has been or may be adversely affected by abuse or neglect by any person to immediately make a report.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 261.101(a), Family Code, to require a person having cause to believe that a child's physical or mental health or welfare has been or may be adversely affected by abuse or neglect by any person to immediately make a report as provided by this subchapter.

 

SECTION 2.  Effective date: September 1, 2009.
