AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
The goal of this legislation is to promote patriotism as well as economic development in the United States of America and the State of Texas.
As proposed, S.B. 907 requires that each United States flag purchased by a state or governmental agency be manufactured in the United States, and that each Texas state flag purchased by a state or governmental agency be manufactured in this state.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Chapter 2158, Government Code, by adding Subchapter H, as follows:
SUBCHAPTER H. PURCHASE OF UNITED STATES FLAG OR STATE FLAG
Sec. 2158.401. FLAG PROCUREMENT BY STATE GOVERNMENTAL ENTITY. (a) Defines "state agency."
(b) Requires that each United States flag purchased by a state agency be manufactured in the United States.
(c) Requires that each Texas state flag purchased by a state agency be manufactured in this state.
(d) Provides that a flag is considered to have been manufactured in a location if a substantial majority of the principal components are assembled into the final product in an assembly plant in the location.
SECTION 2. Amends Subchapter Z, Chapter 271, Local Government Code, by adding Section 271.908, as follows:
Sec. 271.908. FLAG PROCUREMENT BY GOVERNMENTAL AGENCY. (a) Defines "governmental agency."
(b) Requires that each United States flag purchased by a governmental agency be manufactured in the United States.
(c) Requires that each Texas state flag purchased by a governmental agency be manufactured in this state.
(d) Provides that a flag is considered to have been manufactured in a location if a substantial majority of the principal components are assembled into the final product in an assembly plant in the location.
SECTION 3. Makes application of this Act prospective.
SECTION 4. Effective date: September 1, 2009.
