BACKGROUND AND PURPOSE
Current law grants the authority to conduct a marriage ceremony to an officer of a religious organization, a justice of the peace, and almost all federal, state, and county judges, except for municipal court judges. The inclusion of municipal court judges would provide citizens with more availability and choice in a marriage ceremony.
As proposed, S.B. 935 includes a judge of a municipal court as a person authorized to conduct a marriage ceremony.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
ANALYSIS
SECTION 1. Amends Section 2.202(a), Family Code, to include a judge of a municipal court as a person authorized to conduct a marriage ceremony.
SECTION 2. Makes application of this Act prospective.
SECTION 3. September 1, 2009.
EFFECTIVE DATE
September 1, 2009.
