AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

When large vehicles are parked in driveways in residential areas, they are capable of impairing visibility for neighbors trying to back out of their driveways.  There are environmental concerns because it is not uncommon for the large vehicles, when parked for extended periods of time, to have leaks or seepage, which over time can affect the surrounding ground water supply.  Additionally, there can be a diminutive effect on a neighborhood's property values.

 

As proposed,  S.B. 1021 prohibits a person from parking a commercial motor vehicle or leaving the vehicle parked in a private driveway in a residential subdivision.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 545.307, Transportation Code, by amending Subsections (b) and (b-1), as follows:

 

(b)  Prohibits a person, except as provided by Subsection (b-1), after 10 p.m. and before 6 a.m., from parking a commercial motor vehicle or leaving the vehicle parked in a private driveway that is located in a residential subdivision.  Makes nonsubstantive changes.

 

(b-1)  Authorizes a person to park a commercial motor vehicle or leave the vehicle parked in a private driveway that is located in a residential subdivision, or on a street for which signs are posted as provided by Subsection (c) (relating to residents being authorized to petition a county or municipality for the posting of signs prohibiting overnight parking of a commercial vehicle) if the commercial motor vehicle is transporting persons or property to or from the residential subdivision or performing work in the subdivision and remains parked in or adjacent to the subdivision only for the period necessary to complete the transportation or work.

 

SECTION 2.  Effective date:  September 1, 2009.
