AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, there are no uniform reporting requirements for the various state boards (boards) overseeing health care professionals.  Because of the lack of uniform reporting requirements, the state legislature is unable to assess the efficacy of board actions, such as licensing, licensure revocation, licensure suspension, complaints, reprimands, or investigations. This legislation is intended to enable the legislature to better assess patient safety and the effectiveness of these boards.

 

As proposed,  S.B. 1058 requires health occupation regulatory agencies to file an annual report that contains certain information with each legislative committee with oversight responsibility over the reporting agency. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle A, Title 3, Occupations Code, by adding Chapter 114, as follows:

 

CHAPTER 114. REPORTING REQUIREMENTS APPLICABLE TO MULTIPLE HEALTH OCCUPATION REGULATORY AGENCIES

 

Sec. 114.001.  DEFINITIONS.  Defines "health care practitioner" and "health occupation regulatory agency" (agency).

 

Sec. 114.002.  ANNUAL REPORT TO LEGISLATURE.  (a)  Requires each agency, not later than February 1 of each year, to file a report with the chairs of the house and senate committees with primary oversight over the agency that includes the number of persons regulated by the agency, the number of persons who became subject to regulation by the agency in the previous year, the number of persons regulated by the agency by county, a description of any complaints reported to the agency or a description of the complaint categories used by the agency and the number of complaints in each category, the number of complaints investigated by the agency and a description of the final resolution of the complaints, the amount of fees collected by the agency each year, the expenses of the agency, and any unfunded needs of the agency.

 

(b)  Requires the Health Professions Council (HPC) to adopt a standard format that is required to be used by agencies to report the information required under Subsection (a).

 

SECTION 2.  Requires HPC, not later than January 1, 2010, to adopt the standard reporting format required under Subsection (b), Section 114.002, Occupations Code, as added by this Act.

 

SECTION 3.  Effective date: September 1, 2009.
