AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, amusement parks are largely unregulated entities.
C.S.S.B. 1181 amends current law relating to the employment of certain persons by amusement parks.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends the heading to Chapter 2151, Occupations Code, to read as follows:
CHAPTER 2151. REGULATION OF AMUSEMENT RIDES AND AMUSEMENT PARKS
SECTION 2. Amends Section 2151.002, Occupations Code, by adding Subdivision (7), to define "amusement park."
SECTION 3. Amends Chapter 2151, Occupations Code, by adding Subchapter E, as follows:
SUBCHAPTER E. AMUSEMENT PARK REGULATION
Sec. 2151.201. PROHIBITED EMPLOYMENT OF PERSONS CONVICTED OF CERTAIN SEXUAL OFFENSES. Prohibits an owner or operator of an amusement park from employing in an amusement park a person who has been convicted of, entered a plea of nolo contendere or guilty to, or received deferred adjudication for an offense involving prostitution or another sexual offense.
SECTION 4. Effective date: upon passage or September 1, 2009.
