AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, legislators can contract with the state for business purposes but are not required to disclose the business arrangements to the public.  S.B. 1200 is intended to improve transparency in legislators' business dealing with state agencies.

 

C.S.S.B. 1200 amends current law relating to disclosure of contracts between a member of the legislature or a business entity in which the member has a substantial interest and a state agency.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 572, Government Code, by adding Section 572.0253, as follows:

 

Sec. 572.0253.  REPORT OF CONTRACT WITH STATE AGENCY.  (a)  Requires a member of the legislature to report on the financial statement the identification and amount of any contract entered into during the period covered by the statement between the member, or a business entity in which the member as a substantial interest, and a state agency.

 

(b)  Provides that Sections 572.005(3) (relating to an individual having a substantial interest in a business entity if the individual owns more than $25,000 of the fair market value of the business entity), (5) (relating to an individual having a substantial interest in a business entity if the individual is a member of the board of directors or other governing board of the business entity), (6) (relating to an individual having a substantial interest in a business entity if the individual serves as an elected officer of the business entity), and (7) (relating to an individual having a substantial interest in a business entity if the individual is an employee of the business entity) do not apply in determining whether, for purposes of this section, an individual has a substantial interest in a business entity.

 

SECTION 2.  Provides that Section 572.0253, Government Code, as added by this Act, applies only to a financial statement required to be filled under Subchapter B (Personal Financial Statement), Chapter 572, Government Code, on or after September 1, 2009.

 

SECTION 3.  Effective date: September 1, 2009.
