AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, Sections 22.04 and 22.05, Alcoholic Beverage Code, limit the number of package store permits a person can hold.  These sections allow for some people to hold more package store permits than others.  S.B. 1216 will place all persons under the same regulations in holding package store permits.

 

As proposed, S.B. 1216 repeals Sections 22.04 and 22.05, Alcoholic Beverage Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Repealer: Section 22.04 (Limitation on Package Store Interests), Alcoholic Beverage Code.

 

Repealer: Section 22.05 (Consolidation of Permits), Alcoholic Beverage Code.

 

SECTION 2.  Effective date: September 1, 2009.
