AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

An order vesting title to a public road or portion of a public road that is closed, abandoned, and vacated to the center line of the road must be filed in the deed records of a county and serves as the official instrument of conveyance from the county to the owner of the abutting property.  These orders sometimes contain insufficient information to serve the purpose for which they were designed and are hard to locate because there are no uniform guidelines for filing them in the county deed records. 

 

S.B. 1614 requires that these orders include the name of each property owner who receives a conveyance and the dimensions of the property being conveyed to each property owner.  This bill also requires that the orders be indexed in the county deed records in a manner that describes the county conveying the property as grantor and the property owner receiving the conveyance as the grantee. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 251.058(b), Transportation Code, to require the order to include the name of each property owner who receives a conveyance under this section, include the dimensions of the property being conveyed to each property owner, and be indexed in the deed records of the county in a manner that describes the county conveying the property as grantor and the property owner receiving the conveyance as grantee.    

 

SECTION 2.  Effective date:  September 1, 2009.
