AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Under the Texas Public Information Act (TPIA), information that relates to the home address, home telephone number, or Social Security number of an individual who works in law enforcement is confidential and may not be disclosed to the public in certain instances. Currently, employees of the Office of the Attorney General (OAG) who are or were assigned to a division that involves law enforcement are not included in this exception.
C.S.S.B. 1692 includes employees of OAG who are or were assigned to a division of that office that involves law enforcement in the TPIA law enforcement exception and under provisions relating to confidentiality of certain information in tax appraisal records.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 552.117(a), Government Code, to provide that information is excepted from the requirements of Section 552.021 (Availability of Public Information) if it is information that relates to the home address, home telephone number, or social security number of certain persons or that reveals whether the person has family members, including a current or former employee of the Office of the Attorney General (OAG) who is or was assigned to a division of that office the duties of which involve law enforcement, regardless of whether the current or former employee complies with Section 552.024 (Electing to Disclose Address and Telephone Number) or 552.1175 (Confidentiality of Addresses, Telephone Numbers, Social Security Numbers, and Personal Family Information of Peace Officers, County Jailers, Security Officers, and Employees of the Texas Department of Criminal Justice or a Prosecutor's Office). Makes nonsubstantive changes.
SECTION 2. Amends Section 552.1175(a), Government Code, to provide that this section applies to current and former employees of OAG who are or were assigned to a division of that office the duties of which involve law enforcement. Makes nonsubstantive changes.
SECTION 3. Reenacts Section 25.025(a), Tax Code, as amended by Chapters 594 (H.B. 41), 621 (H.B. 455), and 851 (H.B. 1141), Acts of the 80th Legislature, Regular Session, 2007, and amends it to provide that this section applies to a current or former employee of OAG who is or was assigned to a division of that office the duties of which involve law enforcement. Makes nonsubstantive changes.
SECTION 4. Effective date: upon passage or September 1, 2009.
