AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

Under Section 1057.106(b), Special District Local Laws Code, the Matagorda County Hospital District (district) is prohibited from signing a lease term that exceeds 25 years.  This provision makes it difficult for the district to enter into lease agreements.

As proposed, S.B. 1712 grants the board of hospital managers of the Matagorda County Hospital District the authority to enter into lease agreements with a maximum term of 99 years.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 1057.107(b), Special District Local Laws Code, as follows:

Sec. 1057.106.  LEASES.  (a)  Makes no changes to this subsection. 

(b)  Prohibits the term of a lease under this section (regarding the lease of certain district property by the board of managers of the Matagorda Count Hospital District) from exceeding 99, rather than 25, years.

SECTION 2.  Effective date:  upon passage or September 1, 2009.
