AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

As proposed, S.B. 1994 amends current law relating to authorizing the provision of state matching funds to municipalities for hurricane preparation and recovery. 

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the division of emergency management in the office of the governor in SECTION 1 (Section 418.075, Government Code) of this bill.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter D, Chapter 418, Government Code, by adding Section 418.075, as follows:

Sec.  418.075.  MATCHING FUNDS FOR MUNICIPAL HURRICANE PREPARATION AND RECOVERY.  (a)  Requires the division of emergency management in the office of the governor (division) to implement a matching funds program to award grants to municipalities as an incentive to create and maintain municipal disaster contingency funds for hurricane preparation and recovery. 

(b)  Requires the division to award the matching funds annually from the state's disaster contingency fund.  Requires the division, if funds are available, to award a grant to a municipality that is equal to 25 percent of the amount the municipality added during the preceding fiscal year to the municipality's disaster contingency fund. 

(c)  Authorizes funds awarded under this section to a municipality to be used only for hurricane preparation and recovery purposes. 

(d)  Requires the division to adopt rules necessary to implement the matching funds program. 

SECTION 2.  Effective date:  upon passage or September 1, 2009.
