AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current law requires that 15 percent of the revenue generated from vessel registration fees, vessel manufacturer or dealer licensing fees, and vessel and outboard motor titling fees, be transferred from Fund 9 (Game, Fish, and Water Safety Account) to Fund 64 (State Parks Account).

 

As proposed,  S.B. 2050 requires the Texas Parks and Wildlife Department (TPWD) to deposit to the credit of the game, fish, and water safety account all revenue, less allowable costs, from certain sources, including fines or penalties imposed by a court for violation of water safety laws; fees and revenue collected that are associated with the conservation of fish and wildlife; vessel and outboard motor titling fees; fees and revenue that are associated with the boater education program; and any other source provided by law.   The bill also repeals the requirement that TPWD transfer 15 percent of all amounts collected during the previous month from certain sources not later than the 10th day of each month. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 11.032(b), Parks and Wildlife Code, as follows:

 

(b) Requires the Texas Parks and Wildlife Department (TPWD) to deposit to the credit of the game, fish, and water safety account all revenue, less allowable costs, from certain sources, including fines or penalties imposed by a court for violation of water safety laws contained in Chapter 31 (Water Safety), rather than of this code; fees and revenue collected under Section 11.027(b) or (c), rather than of this code, that are associated with the conservation of fish and wildlife; vessel and outboard motor titling fees; fees and revenue collected under Section 31.108 (Boater Education Program) that are associated with the boater education program; and any other source provided by law.  Makes conforming changes.

 

SECTION 2.  Repealer:  Section 11.032(c) (relating to a requirement that TPWD transfer 15 percent of all amounts collected during the previous month from certain sources not later than the 10th day of each month), Parks and Wildlife Code. 

 

SECTION 3.  Effective date:  September 1, 2009.
