BACKGROUND AND PURPOSE

 

Section 159.034(a) (relating to filing requirements from the commissioners court), Local Government Code, states that the "commissioners court may contract with the secretary of state for the filing of [financial disclosure] reports[,]" but the secretary of state no longer handles the filing of financial disclosure reports under Section 159.034(a).  For a time, the Texas Ethics Commission assumed the secretary of state's role in Section 159.034(a).  However, presently, neither the secretary of the state nor the Texas Ethics Commission contracts with commissioners courts for the filing of financial disclosure reports under Section 159.034(a).

 

As proposed,  S.B. 2072 deletes existing text in the Local Government Code authorizing the commissioners court to contract with the secretary of state for the filing of certain reports. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

ANALYSIS

SECTION 1.  Amends Section 159.034(a), Local Government Code, to delete existing text authorizing the commissioners court to contract with the secretary of state for the filing of reports under this subchapter.

 

EFFECTIVE DATE

 

Effective date: upon passage or September 1, 2009.
