AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, each state agency is required to deliver paper copies of all agency rules to the lieutenant governor and the speaker of the house of representatives offices.  However, the Texas Register, maintained by the secretary of the state's office, is available in electronic format.  Any legislative office may request to receive email notification of agency rulemaking filings and/or electronic updates from the Texas Register.  This is the current practice for most state offices. 

 

As proposed,  S.B. 2074  requires the secretary of state, on receiving a written request from the lieutenant governor, a member of the legislature, or a legislative agency, to provide the requester with electronic notification of rulemaking filings by a state agency.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 2001.032(b), Government Code, to require the secretary of state, on receiving a written request from the lieutenant governor, a member of the legislature, or a legislative agency, to provide the requestor with electronic notification of rulemaking filings by a state agency, rather than require a state agency to deliver to the lieutenant governor and the speaker of the house of representatives a copy of the notice of a proposed rule when the agency files notice with the secretary of state, under Section 2001.023 (Notice of Proposed Rule).

 

SECTION 2.  Effective date: September 1, 2009.
