AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Coryell County wants to build a new county jail, but it does not have the land upon which to build.  The Texas Department of Criminal Justice (TDCJ) has a small parcel of land that is not being used for key TDCJ-related activities, and it has no future plans for the land.

 

S.B. 2228 relates to the transfer of certain state property from TDCJ to Coryell County.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  (a)  Requires the Texas Department of Criminal Justice (TDCJ), not later than November 1, 2009, to transfer to Coryell County the real property described by Subsection (d) of this section.

 

(b)  Requires Coryell County to use the property transferred under this Act only for a purpose that benefits the public interest of the state.  Provides that if Coryell County no longer uses the property for a purpose that benefits the public interest of the state, ownership of the property automatically reverts to TDCJ.

 

(c)  Requires TDCJ to transfer the property by an appropriate instrument of transfer.  Requires that the instrument of transfer include certain provisions and describe the property to be transferred by metes and bounds.

 

(d)  Sets forth the boundaries of the real property to which Subsection (a) of this section refers.

 

(e) Requires that TDCJ grant to Coryell County certain utility easements to the real property described in Subsection (d) of this section.  Requires that utility easements be mutually beneficial and agreed upon by TDCJ and Coryell County.

 

SECTION 2.  Effective date:  upon passage or September 1, 2009.
