AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The purpose of this legislation is to authorize placement of the Texas Tejano Monument on the south lawn of the State Capitol grounds, by exempting the monument from the current statutory moratorium prohibiting the placement of monuments on the south lawn.

 

C.S.S.B. 2251 amends current law relating to memorial monuments on the Capitol grounds, including the Tejano monument.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 443, Government Code, by adding Section 443.01525, as follows:

 

Sec. 443.01525.  TEJANO MEMORIAL MONUMENT.  Requires the State Preservation Board to establish a Tejano memorial monument on the historic south grounds of the Capitol that pays tribute to the contributions of Tejanos to the State of Texas.

 

SECTION 2.  Amends Section 443.0152, Government Code, by adding Subsection (a-1), as follows:

 

(a-1)  Provides that except as provided by Sections 443.01525 and 448.034 (Location of Monument), after September 1, 2009, no additional monuments are authorized to be placed on the historic grounds of the Capitol.

 

SECTION 3.  Effective date: upon passage or September 1, 2009.
