BACKGROUND AND PURPOSE

 

Currently, a retail public utility must perform a water loss audit every five years and file that audit with the Texas Water Development Board (TWDB). 

 

S.B. 2315 requires a retail public utility receiving financial assistance from TWDB to perform and file with TWDB a water loss audit annually.

 

RULEMAKING AUTHORITY

 

It is the Committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 16.0121, Water Code, by amending Subsection (b) and adding Subsection (g), as follows:

 

(b)  Requires a retail public utility, except as provided by Subsection (g), to perform and file with the Texas Water Development Board (TWDB), every five years, a water audit computing the utility's most recent system water loss.

 

(g)  Requires a retail public utility to perform and file with TWDB a water loss audit annually if the utility is receiving any financial assistance from the board.  Makes nonsubstantive changes.

 

SECTION 2.  Provides the effective date of this Act.

 

EFFECTIVE DATE

 

This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2009.
