AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The 17th, 48th, 67th, 96th, 153rd, 141st, and 236th district courts in Tarrant County have been civil courts since their inception, but they have not been given a formal preference. S.B. 2454 will give civil preference to those courts.

 

S.B. 2454 requires that the 17th, 48th, 67th, 96th, 153rd, 141st, and 236th district courts give preference to civil matters.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 24.118, Government Code, by adding Subsection (d), to require that the 17th District Court give preference to civil matters.

 

SECTION 2.  Amends Section 24.150, Government Code, by adding Subsection (d), to require that the 48th District Court give preference to civil matters.

 

SECTION 3.  Amends Section 24.169, Government Code, by adding Subsection (d), to require that the 67th District Court give preference to civil matters.

 

SECTION 4.  Amends Section 24.198, Government Code, by adding Subsection (c), to require that the 96th District Court give preference to civil matters.

 

SECTION 5.  Amends Section 24.252, Government Code, by adding Subsection (e), to require that the 153rd District Court give preference to civil matters.

 

SECTION 6.  Amends Section 24.352, Government Code, as follows:

 

Sec. 24.352.  141ST JUDICIAL DISTRICT (TARRANT COUNTY).  (a)  Creates this subsection from existing text.

 

(b)  Requires that the 141st District Court give preference to civil matters.

 

SECTION 7.  Amends Section 24.413, Government Code, as follows:

 

Sec. 24.413.  236TH JUDICIAL DISTRICT (TARRANT COUNTY).  (a)  Creates this subsection from existing text.

 

(b)  Requires that the 236th District Court give preference to civil matters.

 

SECTION 8.  Effective date:  upon passage or September 1, 2009.
